München: Uber und Co. dürfen wieder billiger sein

In München kann man eine Fahrt mit einer App bestellen. Zwei bekannte Apps sind Uber und Bolt. Früher war so eine Fahrt etwa 40 Prozent billiger als ein Taxi.

In Munich, you can order a ride with an app. Two well-known apps are Uber and Bolt. In the past, a ride like this was about 40 percent cheaper than a taxi.

Seit Juli gibt es in München Mindestpreise für diese Fahrten. Das heißt: Eine Fahrt mit der App darf nicht zu billig sein. Jetzt stoppt ein Gericht in München diese Mindestpreise.

Since July, Munich has had minimum fares for these rides. This means that a ride booked through an app must not be too cheap. Now a court in Munich has stopped these minimum fares.

Im Moment gibt es also keine Mindestpreise mehr. Fahrten mit Uber und Bolt dürfen wieder billiger sein.

So for now, there are no minimum fares any more. Rides with Uber and Bolt are allowed to be cheaper again.

Ein Gericht in München hat die Mindestpreise für Fahrten mit Apps wie Uber und Bolt gestoppt. Die Firmen müssen sich im Moment nicht mehr an diese Preise halten. Fahrten mit der App können also wieder billiger werden.

A court in Munich has stopped the minimum fares for rides booked through apps such as Uber and Bolt. For now, the companies no longer have to stick to these prices. So these rides can become cheaper again.

Die Stadt hat die Mindestpreise Anfang Juli eingeführt. Sie hat dafür den Preis für ein Taxi als Grundlage genommen. Vorher waren Fahrten mit der App im Durchschnitt etwa 40 Prozent billiger als ein Taxi.

The city introduced the minimum fares at the beginning of July. It based them on taxi fares. Before that, rides booked through an app were on average about 40 percent cheaper than a taxi.

Mehrere Firmen sind deshalb vor Gericht gegangen. Das Gericht hat ihnen in fünf Fällen recht gegeben. Der Grund: Die Mindestpreise gelten auch für Fahrten aus München hinaus, zum Beispiel zum Flughafen. Außerhalb von München darf die Stadt aber keine Regeln machen.

That is why several companies went to court. The court ruled in their favour in five cases. The reason is that the minimum fares also apply to rides out of Munich, for example to the airport. But the city is not allowed to make rules for places outside Munich.

Man kann den Teil für diese Fahrten nicht einfach aus der Regel herausnehmen. Darum ist die ganze Regel wahrscheinlich gegen das Gesetz, sagt das Gericht. Das ist aber noch nicht die letzte Entscheidung. Später prüft das Gericht den Fall noch einmal genau.

The part of the rule about these rides cannot simply be taken out. That is why the whole rule is probably against the law, the court says. But this is not the final decision yet. Later, the court will look at the case again in detail.

From the beginning of July, their prices had to be based on the city's taxi tariff. A taxi ride costs a base fare of €5.90 plus €2.70 per kilometre; the minimum fare for Uber and co. was slightly lower. Before that, rides booked through apps were on average around 40 percent cheaper than a taxi. According to Bolt, demand fell by 44 percent once the minimum fares took effect.

Das Gericht hält die Regel wahrscheinlich für rechtswidrig. Die Stadt hat die Preise nämlich auch für Fahrten aus München hinaus festgelegt, etwa zum Flughafen. Für Orte außerhalb der Stadt ist sie aber nicht zuständig. Weil man diesen Teil nicht vom Rest trennen kann, betrifft das die ganze Regel.

The court believes the rule is probably unlawful. This is because the city also set the prices for rides out of Munich, for example to the airport. But the city has no authority over places outside its boundaries. Because this part cannot be separated from the rest, the whole rule is affected.

Die Stadt hatte mehrere Gründe für die Mindestpreise. Nach Angaben des Zolls haben sich viele Fahrdienste nicht an Arbeitsgesetze und oft auch nicht an den Mindestlohn gehalten. Auch Taxifahrer haben für faire Regeln demonstriert. Außerdem fürchtete die Stadt, dass billige Fahrten den Bussen und Bahnen Fahrgäste wegnehmen.

The city had several reasons for the minimum fares. According to the customs authorities, many ride services did not comply with labour laws and often did not pay the minimum wage either. Taxi drivers also demonstrated for fair rules. The city also feared that cheap rides would take passengers away from buses and trains.

Der Streit ist noch nicht endgültig entschieden: Das war nur ein Eilverfahren, später folgt das Hauptverfahren. Auch in Leipzig, Essen und Köln haben Gerichte ähnliche Mindestpreise schon gestoppt. Der Branchenverband der Fahrdienste hat die Entscheidung begrüßt.

The dispute has not been finally decided yet: this was only a fast-track procedure, and the main proceedings will follow later. Courts in Leipzig, Essen and Cologne have already stopped similar minimum fares as well. The industry association for ride services welcomed the decision.

Weil man diesen Teil nicht einfach vom Rest trennen kann, ist nach Ansicht der Richter die gesamte Regel betroffen.

According to findings by the customs authorities, many ride services did not comply with labour and social security laws and often did not pay the minimum wage either. Taxi drivers had also taken to the streets for fair rules. The city also feared that very cheap rides would take passengers away from buses and trains.

Endgültig entschieden ist der Streit aber noch nicht. Wie er ausgeht, klärt sich erst in einem späteren Hauptverfahren. Gerichte in Leipzig, Essen und Köln hatten ähnliche Mindestpreise zuvor ebenfalls gestoppt. Der Branchenverband der Fahrdienste begrüßte die Entscheidung aus München.
